The tax regime applicable to the provision of services through technological platforms such as Uber is “Régimen de Actividades Empresariales con ingresos a través de plataformas tecnológicas”, you may be registered under other regimes as long as you validate it with a tax advisor.
If a user requests an invoice for services you’ve provided through the Uber app, you must issue that invoice and provide it to the user to fulfill your tax obligations. By uploading your Digital Seal Certificate (DSC) and e.firma to the Uber system and accepting the Terms and Conditions, an authorized provider will issue invoices requested by users on your behalf, using your tax credentials. This helps you fulfill your tax obligations more easily and efficiently.
Please allow 24 to 48 hours for your information to be validated. If your information is correct, your tax profile status will appear as “ACTIVE.”
If, after 24 to 48 hours, your tax profile status appears as “INACTIVE,” verify that all information is correct and upload it again.
If you don’t have your RFC code or don’t know it, we recommend going to a SAT office or consulting a tax advisor. It’s important that you provide your RFC code correctly, because if you don’t provide it or if it appears invalid to the SAT, Uber will be required to withhold a penalty of 16 % IVA and 20 % ISR.
The tax regime you must select depends on the type of economic activity you are carrying out. Each activity has a specific tax regime assigned to it. If you start or stop carrying out an economic activity, you must update the applicable tax regime registered with the SAT (Tax Administration Service). We recommend visiting a SAT office or consulting a tax advisor to complete the corresponding update.
In compliance with current tax laws, Uber is required to withhold and pay to the government on your behalf applicable taxes (IVA and ISR) for the services you provide through the platform.
If you’ve specific questions about withholdings, we suggest you consult the following article: How do tax withholdings on earnings work?
