Uber expects drivers to comply with all state, federal, and local laws when it comes to transporting riders. According to Uber's Community Guidelines, linked below, discrimination of any kind is not tolerated by riders or drivers.
This includes refusing to transport riders based on characteristics protected under federal law. These characteristics include, but are not limited to:
Age (40 and over)
Uber has a zero tolerance policy towards discrimination of any kind. This means you will lose access to your account if you are found to have refused service to riders based on any of the above characteristics.
