What is MII?
Every car used on a public road must have valid Compulsory Third Party (CTP) insurance that provides coverage for your liability for causing the death of, or injury to any other person, including passengers.
CTP provides cover for bodily injuries only. CTP does not protect you against any claim for property damage, i.e. damage to your own car or other people's property.
The Insurance Commission of Western Australia (ICWA) is the State's insurer providing CTP insurance. CTP is also known as Motor Injury Insurance (MII) in Western Australia.
What can I claim?
If another driver was at-fault in an accident, whether completely or in part, you are eligible to claim for medical and health treatment costs, economic loss and compensation for pain and suffering.
What if I'm at-fault?
The MII is a fault-based scheme. If you are totally at-fault, you are not eligible for any benefit under the scheme. Where you are partially at-fault, you may still claim for compensation but the compensation may be reduced.
What if I'm not at-fault?
If you are injured in an accident that is caused by the driver of another car, you may claim for the benefits as allowed under the MII scheme. Your compensation may be reduced if you are partially at-fault.
Do I need to buy more insurance if I drive for Uber?
The MII scheme does not provide any cover for property damage such as damage to your own car or another car. Uber requires all Driver Partners to have at least third party property insurance to cover liability that you may incur for damage caused to another person's property. You are also encouraged to purchase comprehensive insurance cover, so that you will be protected for your own car's damage if an accident occurs.
