I would like to make a claim for compensation

Under the September 19, 2023 agreement, if the driver’s account has been suspended due to an obvious error on the part of the platform, the latter will pay compensation for the time the account was suspended.

Eligibility conditions

  • Your driver account has been suspended for more than 72 hours due to an “obvious error” on the part of the platform.
  • The request for compensation was made within 15 days of the reactivation of your account.
  • The temporary suspension of your account took place after January 1, 2024.

Manifest platform error

We define a manifest error as any unfounded suspension caused by an error on the part of an Uber agent.

Manifest errors do not include:

  • All cases where the driver’s access has been reinstated after a review of his account as part of the second chance process (more information on this page).
  • Any technical bugs encountered by the application.
  • All suspensions as a precautionary measure during a safety investigation (including if the passenger’s testimony was unfounded).

Amount of compensation

The daily amount of compensation is set by the agreement of September 19, 2023, and is equal to the average daily income from VTC driver activities (as defined in article R. 1326-4 of the French Transport Code) that you have earned over the 12 weeks preceding the suspension. This amount is due for each day of suspension, from the 4th day onwards, up to a maximum of 30 calendar days per precautionary suspension.

For example, if your total sales, after commission, were €21,000 over the full 12 weeks, your average daily income would be calculated as 21,000/(12*7)=€250/day. If your account has been suspended for 5 days, you could therefore receive (5-3)x250€=500€. (3 being the number of days for which compensation is not due).

Following your request, an Uber agent will contact you to inform you of the decision. If you are eligible for compensation, it will be paid to the bank account specified in your driver account within 2 weeks.

For the sake of clarity, the transfer is made to the bank account linked to the VTC operator registered with Uber (and not to the individual driver, if different).
